Terms of Sale
These terms of sale (these "terms of sale") govern your purchase of any product offered by organicstats.com on www.organicstats.com. Please read these terms of sale carefully. They contain very important information about your rights and obligations as well as limitations and exclusions that may apply to you. By placing an order, you acknowledge that you have read, accepted and have agreed to be bound by these terms of sale, without limitation or qualifications. These terms of sale are subject to modification without prior written notice and at any time in organicstats.com's sole discretion.
Pricing
All prices on our Web site are listed in U.S. dollars. Please refer to the product description on the OrganicStats Web site for the listing of the price of each of the products available for sale directly through OrganicStats.
Payments
Payments are charged to your credit card at the time you place your order. OrganicStats LLC, employs a third-party payment processing systems provided by PayPal and 2CO. If you are paying for your subscription using one of these payment processing systems, you will be required to provide your name, e-mail address, and credit card information. No credit card information is transferred or stored by OrganicStats. OrganicStats LLC, may change its pricing at any time without prior notice to customer, but such changes shall not affect any accepted orders.
Recurring Payments
If a service is selected with recurring payments, those payments shall continue recurring until customer cancels recurrance through the payment provider (i.e. PayPal or 2CO). You will not be notified in advance of your impending renewal.
Typographical and Photographical Errors
OrganicStats LLC, attempts to be as accurate as possible in our pricing, as well as our typographical and photographical depictions of products for sale; however, we cannot guarantee that product descriptions/specifications, pricing or any other content on ZipZoomFly.COM is accurate, complete, or current. In the event that a product is listed at an incorrect price due to typographical, informational, technical or other error, ZipZoomFly shall have the right, at our sole discretion, to either honor the displayed price or refuse/cancel any orders placed for that product at the incorrect price.
Indemnification
EXCEPT AS PROVIDED ABOVE, ORGANICSTATS LLC, DISCLAIMS ALL OTHER WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OR MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OTHER THAN THOSE WARRANTIES IMPLIED BY AND INCAPABLE OF EXCLUSION, RESTRICTION OR MODIFICATION UNDER APPLICABLE LAW. THE TERM OF ANY IMPLIED WARRANTIES THAT CANNOT BE DISCLAIMED ARE LIMITED TO THE TERM OF YOUR MEMBERSHIP.
YOU AGREE TO DEFEND, INDEMNIFY AND HOLD COMPLETELY HARMLESS ORGANICSTATS LLC, FROM AND AGAINST ANY AND ALL CLAIMS, DAMAGES, COSTS, AND EXPENSES, INCLUDING ATTORNEYS’ FEES, ARISING FROM OR RELATED TO YOUR USE OF THE PRODUCTS PURCHASED VIA THE SITE.
Liability
In no event shall OrganicStats's liability exceed the purchase price of the products purchased hereunder.
Use of the web site
Neither the Company nor any of its officers, directors, employees or affiliates shall be liable for any direct, indirect, special, consequential, punitive, exemplary and/or incidental damages of any kind whatsoever (including, but not limited to, lost profits or attorneys' fees) in any way due to, resulting from or arising in connection with your access to, inability to access, or use of the site, or from your reliance on any information provided at the site, even if the Company has been advised of the possibility of such damages. This limitation applies to all causes of action in the aggregate including, but not limited to, breach of contract, breach of warranty, negligence, strict liability, misrepresentation, and any other tort. In the event the foregoing limitation of liability set forth herein shall be for any reason held unenforceable or inapplicable, you agree that the Company and its affiliates' aggregate liability shall not exceed the amount paid pursuant to the terms of this Agreement.
